1 · Scope and provider

These terms of use govern your use of the iOS app „My Day“ (bundle id com.tilmann.myday, including its home screen widget) and of the paid feature set My Day Pro. They apply between you and:

Distribution runs exclusively through Apple: the release version through the App Store, pre-release versions through Apple’s TestFlight. Test versions may be incomplete, may change without notice and may behave differently from the release version. Apple’s own terms — in particular the Apple Media Services Terms and Conditions and the licence terms for apps — apply in addition to these terms and take precedence where they conflict with them.

Your own conflicting or supplementary terms do not become part of the contract unless we have agreed to them in text form.

How we handle your data is described separately in our privacy policy; it is not part of these terms.

2 · Conclusion of contract

2.1 Contract of use for the app

The contract for the use of the app comes into effect when you create an account in the app (email address and password) or sign in. This contract of use is free of charge and runs for an indefinite period. It requires an iPhone running a supported version of iOS, an Apple Account, an internet connection and an account in the app. Use requires full legal capacity; minors need the consent of their legal guardians.

With the contract of use you receive a simple, non-exclusive, non-transferable and revocable right to use the app on the devices assigned to your Apple Account — for private purposes or to organise your own professional life. All rights in the app, its source code, its design and its contents remain with the provider. The rights in the content you create yourself of course remain yours.

2.2 Purchase contract for a Pro subscription

A Pro subscription is concluded exclusively as an in-app purchase through the App Store. The purchase contract for the subscription is concluded between you and Apple — Apple is the seller and handles payment, invoicing, renewal and refunds. For users in the European Economic Area the contracting party is Apple Distribution International Ltd., Hollyhill Industrial Estate, Hollyhill, Cork, Ireland; for users outside the EEA a different Apple entity may be the contracting party. The binding statement is the one in the Apple Media Services Terms and Conditions that Apple makes available to you at the time of purchase. The contract comes into effect when the purchase is confirmed through your Apple Account; Apple issues you a purchase confirmation for it.

In addition, the Apple Media Services Terms and Conditions, which Apple makes available to you during the purchase, apply to this purchase. We are not a party to this purchase contract and have no access to your payment details. What reaches us is limited to the purchase and subscription events that our subscription provider reports back — the type of event and its id, the app user id under which your account is known there, the environment, the entitlement ids, the expiry time and the associated timestamps. We use these to unlock the Pro features.

2.3 Relationship with Apple

These terms exist between you and the provider, not between you and Apple. The provider alone is responsible for the app, its contents, its maintenance and support; Apple has no obligation in that respect. Apple Inc. and its subsidiaries are third-party beneficiaries of these terms and are entitled to enforce them against you.

3 · Description of the service

My Day is a personal planning app with four linked modules: to-dos, calendar, habits and fitness. Entries in one module can refer to entries in another.

3.1 Free

The app is fully usable free of charge. Free includes, among other things and without any additional payment:

• all four modules with no upper limit on the number of tasks or habits,
• accent colours and backgrounds,
• the connection to the Apple Calendar on your device,
• synchronisation across several devices with the same account,
• file export and import of your own data,
• the HealthKit sync of your workouts.

3.2 Pro

My Day Pro unlocks exactly the following and nothing else:

• All AI actions. Without a subscription you have 0 AI actions per month; with Pro, 3,000 AI actions per calendar month (counted in UTC, reset at the start of the month, no carry-over of unused actions). The allowance is counted and enforced on our server.
• The stronger AI model. Pro requests are processed with gemini-2.5-pro. Without Pro, requests fall back to the smaller model gemini-2.5-flash. The choice of model happens on our server.
• Automatic day planning („Plan my day“).
• Focus time placed into the next free gap in your calendar.
• The weekly review and the preview of tomorrow.
• The home screen widget with your next event and your three most important tasks.

Functions other than those listed here are not subject to payment. In particular, accent colours, the Apple Calendar connection, device synchronisation, file export and import and the Apple Health sync are not part of Pro.

We continue to develop the app. Changes to the digital product that go beyond what is necessary to maintain conformity with the contract are made by us only under the conditions of section 327r of the German Civil Code (BGB).

4 · Prices, term and automatic renewal

• Monthly: €9.99 per month.
• Annual: €59.99 charged once per year — less than €5 per month.

The price shown in the App Store at the time of purchase is the one that applies; it is the final price payable including any applicable value added tax. Apple may display the price in your local currency.

There is no trial period. The subscription is charged from the start of the term.

My Day Pro is an auto-renewable subscription. It runs for the term you booked (one month or one year) and renews automatically for the same term, at the price applicable at the time, unless you cancel at least 24 hours before the end of the current period. Apple charges the renewal to your Apple Account within the 24 hours before the new period begins.

If a payment fails or your subscription lapses, the Pro features stop being available at the end of the paid period. Your data stays untouched — the app keeps working, only the Pro features listed in section 3.2 are locked again.

Price changes take effect at the earliest from the next renewal period. Apple informs you about a price increase and, where required, obtains your consent; if you do not give it, the subscription ends when the current period expires.

5 · Cancellation

You cancel the subscription with Apple, at any time and without giving a reason. There is no cancellation button in our app, because we do not process the payment:

• on your iPhone: Settings → your Apple Account → Subscriptions → My Day, or
• directly at apps.apple.com/account/subscriptions.

The cancellation must reach Apple at least 24 hours before the end of the current period, otherwise the subscription renews once more. After cancelling, Pro remains available until the end of the period you have already paid for. There is no pro-rata repayment for a period already begun, unless mandatory law provides otherwise.

Deleting the app or deleting your My Day account does not cancel the subscription. Only you can cancel it, at Apple. The app points this out before you delete your account.

You can end the free contract of use at any time and without notice by deleting your account in the app: Profile → Danger zone → Delete account. This permanently removes all data stored for you on our servers.

The right of either side to terminate for good cause remains unaffected.

6 · Right of withdrawal

As a consumer you are, as a rule, entitled to a fourteen-day right of withdrawal from a distance contract for digital content (sections 312g, 355 of the German Civil Code, BGB).

Because the subscription contract is concluded with Apple (section 2.2), the right of withdrawal is exercised against Apple, and Apple processes any refund. You request this through Apple’s „Report a Problem“ process for App Store purchases or through Apple Support. We cannot issue refunds for purchases made through the App Store — we never receive the payment ourselves.

Please note that for digital content the right of withdrawal lapses early if you have expressly consented to performance of the contract beginning before the withdrawal period ends and have confirmed that you thereby lose your right of withdrawal (section 356(5) BGB). Whether and how that consent is obtained depends on the purchase process in the App Store. This does not affect any refund Apple grants voluntarily under its own rules.

The contract for the free use of the app does not involve any payment obligation on your part; you can end it at any time by deleting your account in the app.

7 · Voucher codes

We occasionally issue voucher codes that, once redeemed in the app, unlock My Day Pro for the period stated on the code (as a rule twelve months). The following applies to them:

• A voucher code is not a means of payment, has no monetary value and does not constitute a payment. It is not paid out in cash, refunded or offset.
• Redemption is only possible in the app with a signed-in account. A code can be redeemed only once per account.
• A redeemed code is tied to the account it was redeemed on and is not transferable. There is no claim to a replacement if it is lost or passed on.
• When the period is over, Pro ends automatically. This does not create a paid subscription, and nothing is charged.
• A voucher does not cancel a running Apple subscription and does not replace one. If both run in parallel, Apple continues to charge for the subscription unchanged.
• We may deactivate codes that were obtained improperly, distributed publicly or guessed by machine. To protect against this, the number of failed redemption attempts per account and hour is limited.

8 · Your obligations

You are responsible for what happens through your account. Please keep your password to yourself and do not pass your access on to others.

When using the app, in particular the AI features, you undertake not to:

• send automated or bulk requests — no scripts, bots, scrapers or scheduled jobs that trigger AI actions, and no use of the app or its backend as a general-purpose interface to the AI model,
• circumvent, manipulate or artificially reset the monthly limit on AI actions or the server-side model selection, for instance by creating additional accounts for that purpose,
• resell the AI features, make them available to third parties or use them for the benefit of third parties,
• enter content that is unlawful, that infringes third-party rights, or that you are not permitted to disclose — in particular other people’s personal data or confidential information,
• attempt to attack, overload, reverse engineer or gain unauthorised access to the app, our backend or our API keys, or to bypass technical protection measures.

If you breach these obligations, we may throttle or temporarily suspend individual functions, and in the event of a serious or repeated breach block your account or terminate the contract without notice. A paid subscription is not automatically ended by this — you have to cancel it with Apple (section 5). Any claims for damages we may have remain unaffected.

9 · Availability

We do our best to keep the service running, but we do not owe uninterrupted availability. Interruptions can occur through maintenance, updates, faults, force majeure, or through outages at services we build on — in particular our database and server provider, the AI provider and Apple.

The AI features additionally depend on a third-party model. They may be temporarily unavailable, slower, or delivered by a different model if the provider changes, restricts or discontinues the model. Where an outage lasts significantly longer than briefly and affects the paid features, your statutory rights remain unaffected.

The core of the app works on your device. Please keep your own backups of important data — the export function in the app is there for exactly that.

10 · Liability

We are liable without limitation for damage arising from injury to life, body or health, for intent and gross negligence, in cases covered by the German Product Liability Act, and to the extent we have given a guarantee.

In the case of slight negligence we are liable only for the breach of a material contractual obligation — an obligation whose fulfilment makes the proper performance of the contract possible in the first place and on whose observance you may regularly rely. In that case liability is limited to the foreseeable damage typical for this kind of contract.

Any further liability is excluded. This limitation also applies in favour of our employees, representatives and agents.

Nothing in these terms excludes or limits liability for intent, for gross negligence or for personal injury, and nothing in them limits your mandatory statutory rights as a consumer.

11 · Notice about the AI features

The AI features generate their answers with a language model. The output can be wrong, incomplete, out of date or entirely made up, even when it sounds confident. Check anything that matters before you act on it — dates, times, appointments and figures in particular. Suggested schedules are suggestions, not commitments; we do not guarantee any particular result.

My Day does not provide medical, legal, tax or financial advice, and the AI output is not a substitute for professional advice. In a medical emergency, contact a doctor or the emergency services.

The fitness and health information in the app is self-reported by you or imported from Apple Health. My Day does not check it, does not diagnose, does not treat and does not monitor anything. The app is not a medical device within the meaning of the applicable medical device legislation and must not be used as one.

12 · Changes to these terms

We may amend these terms where there is an objective reason for doing so — for example a change in the law or in the case law of the highest courts, an adjustment to new or changed functions, a change of the service providers we use, or the closing of a gap in the provisions. The amendment must not shift the balance between performance and consideration to your disadvantage.

We publish the version applicable at any given time on this page; the date in section 14 shows the status. The version that applies is the one published at the time the contract was concluded, or at the start of the respective renewal period. Amended terms therefore take effect for a running subscription at the earliest from the next renewal period. If you do not agree with an amendment, you can cancel your subscription with Apple at the latest 24 hours before that period begins (section 5) and delete your account in the app.

13 · Governing law and dispute resolution

The law of the Federal Republic of Germany applies, to the exclusion of the UN Convention on Contracts for the International Sale of Goods. If you are a consumer with your habitual residence in another country, the mandatory consumer-protection provisions of that country remain unaffected by this choice of law.

The place of jurisdiction is determined by statute.

We are neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board.

Should individual provisions of these terms be or become invalid, the validity of the remaining provisions is unaffected.

The German version of these terms is the binding one. This English text is a faithful translation provided for convenience; where the two differ, the German AGB prevail.
